Contract conclusio with seller

To conclude purchase contract for one or more products on www.filippodelaurentiis.it, www.filippodelaurentiis.it, fill in electronic order form and send it to Seller electronically, follow relative instructions.
It contains the reference to General Conditions of Sale, description of product, quantity and its price, means of payment that can be used, a reference to conditions for exercising the right of annulment (paragraph 7); methods and times for returning purchased products (paragraph 7).Before concluding contract, you will be asked to confirm reading of General Conditions of Sale including Information on right of annulment and processing of personal data. Language available to conclude contract with Seller is Italian. Once contract is concluded, Seller takes charge of order for its fulfillment.
Seller may not process purchase incomplete or incorrect orders or for unavailability of products, or if payment has not been received. In these cases, we will inform you by email that contract is not concluded and that Seller has not followed up on purchase order specifying the reasons. Warranties and products prices

On www.filippodelaurentiis.it only products marked with FILIPPO DE LAURENTIIS brand are offered for sale.
Seller doesn't sell used or irregular products.
Essential characteristics of products are presented on www.filippodelaurentiis.it. However, images and colors of products offered for sale on www.filippodelaurentiis.it may not correspond to real ones due to the effect of Internet browser and the monitor used.
Product prices may be updates. Make sure of the final sale price before submitting the relevant order.
Purchase requests from countries not included among those displayed on site cannot be accepted by Seller.
All products come with an identification label attached with a disposable seal. We ask you not to remove label and its seal from purchased products, of which they form an integral part.
Seller, if you exercise your right of annulment, has the right to don't accept return or not to fully refund amounts paid for purchase, in relation to those products that do not have the label or that have been altered in their essential and qualitative characteristics or which have been damaged, as better explained in paragraph 7.5.
All products sold by Seller are covered by the twenty-four (24) month legal warranty for defects of conformity, in accordance with applicable law. Lack of conformity of product must be communicated to Seller within two (2) months of its discovery. Lack of conformity can be communicated to Seller by contacting Customer Service.

Payments

To pay products and related shipping and delivery costs, you can follow one of methods indicated in order form. In no case will you be charged costs higher than those actually incurred by Seller, in relation to payment instrument chosen.
It is possible to pay for order with the following payment methods: credit card, Paypal, Scalapay.
In case of electronic payment, financial information (for example, number of credit / debit card or the expiry date) will be forwarded, through an encrypted protocol to Paypal which will provide related remote electronic payment services, without third parties having access to it. his information will never be used by Seller except to complete procedures relating to your purchase and to issue relative refunds in case of product returns, following your annulment, or if it becomes necessary prevent or report to police the fraud on www.filippodelaurentiis.it. Price of products and shipping costs, as indicated in order form, will be charged to your bank account when products purchased are shipped.
If you buy with Scalapay you will receive your order immediately and pay in 3 installments. You acknowledge that the installments will be transferred to Incremento SPV S.r.l., to related parties and their assignees, and that you authorize this transfer.

Shipping and delivery

You can receive purchased items at chosen address.
Please pay attention to what is reported in this section cause the indications are integral and substantial part of these General Conditions of Sale and, must be considered known and accepted at time of order transmission.
Goods are prepared and delivered to chosen forwarder by 48/72 hours of receiving payment.
Orders received on Friday after 12.00 am and orders received on Saturday and Sunday will be delivered to carrier by 1/2 working days.
Delivery times are for indicative purposes only and, although they are usually respected, we cannot guarantee them, being subject to events beyond our control and responsibility.
At the shipment you will receive from us or from courier communication of shipping number that can be used to check delivery status.
Upon delivery, check that the packaging / envelope is intact. Our packaging / envelopes will be closed with our logoed tape. If you find any damage you can contest them by placing a reasoned written control reserve (like "crushed packaging" or "torn envelope"). Only by fulfilling this operation will you be able to activate the refund procedure.

Right of termination

Pursuant to art. 64 and following of the Legislative Decree n. 206/2005, if customer is a consumer (i.e. a natural person who buys goods for purposes not related to his professional activity, or does not make the purchase by indicating in the order form to AEFFE Lab S.r.l., on behalf of Ferrante Brands srl a VAT number reference), has the right to withdraw from purchase contract for any reason, without penalty and without prejudice to what is indicated in point 7.3.
To exercise this right, you will have to:

Log in to your account and visit "Order history and detail" section: select product or products you wish to return.
Tell us reason for return and click on "send return request".
Once return request is authorized you will receive an email with RMA number to be placed on package.
Returned goods must reach to AEFFE Lab s.r.l. no later than 14 working days from delivery, and must be sent to:

Right of termination is subject to following mandatory conditions:

Right applies to purchased product in its entirety; it is not possible to exercise termination only on part of purchased product;
Purchased good must be intact and returned in original packaging, complete in all its parts (including packaging, label, any disposable seal and any documentation); we ask you to enter RMA number (return authorization code) issued by AEFFE Lab s.r.l
Shipping costs for returning are charged to customer or to AEFFE Lab in case of a "Free Return" promotion;
Shipment, until the certificate of receipt in our warehouse, is under full responsibility of customer;
In the event of damage to goods during transport, AEFFE Lab s.r.l. will notify at Customer of the incident (within 14 working days of receipt of goods in its warehouses), to allow them to file a complaint against courier chosen by him and obtain a refund of the value of goods (if insured); in this case, product will be made available to customer for its return, canceling request for termination;
AEFFE Lab s.r.l. doesn't respond in any way for damage or theft / loss of goods returned by uninsured shipments;

AEFFE Lab s.r.l. will refund in the shortest possible time and in any case within 14 days from the date of receipt of goods, upon notice of termination, by reversing the amount charged to Credit Card, Paypal account or by bank transfer. In this case, customer will promptly provide bank details on which to obtain the refund (Code ABI - CAB - Current Account-SWIFT of invoice holder).
What we’ll refund: Product cost;
What we’ll deduct from the refund: If you choose to ship back your package with our carrier, we’ll deduct from your refund the cost of the standard shipping;
Right of termination is lost for lack of the essential integrity of goods (packaging and / or its contents), in cases where AEFFE Lab s.r.l. finds:

Damage to product for reasons other than its transport;
Use or washing of clothes;
Dirty product due to its use, which has compromised its integrity.
Costs and risks of transport for return are fully borne by customer. Return of non-intact or deteriorated products will not be accepted by AEFFE Lab s.r.l. and will be returned to sender with an increase in transport costs. In case of forfeiture of the right of termination, AEFFE Lab s.r.l. will return purchased good to the sender, charging shipping costs to the same.

Applicable law and dispute resolution

These General Conditions of Sale are governed by Italian law and interpreted on the basis of it, without prejudice to any other prevailing mandatory rule in the country of habitual residence of buyer. Interpretation, execution and termination of General Conditions of Sale are subject exclusively to Italian law.
Any disputes inherent and / or consequent must be resolved exclusively by Italian judicial authority. If buyer holds the status of Consumer, any disputes will be exclusive competence of the Court of Pescara.

Safeguard clause
